1. About these terms
Sitesides is operated by Elijah Archer, trading as Sitesides (ABN 59 600 190 704), in Broome, Western Australia. Contact us at contact@sitesides.com. These terms explain use of this website and the basis on which we provide website services.
Your written quote or service agreement sets out the specific project terms. You have the opportunity to review it before accepting. Sending an enquiry, selecting a package or using this website does not place an order, authorise payment or create a subscription.
2. Quotes and project scope
Before work starts, we agree in writing on the pages, content, features, revisions, responsibilities, timing and fees. Quotes are valid for the period shown in the quote. Extra work or changes to scope need an updated quote or written agreement before we proceed.
Any project-specific terms are supplied for review before acceptance. If they vary these general terms, the agreed project terms apply to that specific issue, subject to rights that cannot legally be excluded.
3. Pricing, monthly inclusions and payment
One-Page Website: $99 upfront + $60 per month; up to 30 minutes of routine edits each month.
Starter Website: $199 upfront + $80 per month; up to 1 hour of routine edits each month.
Business Website: $350 upfront + $110 per month; up to 2 hours of routine edits each month.
All amounts are in Australian dollars. Elijah Archer is not registered for GST and GST is not charged. Final pricing depends on your content, features and project scope. Your quote confirms the total charges before you commit.
The upfront amount covers the agreed initial website build and is payable after you accept the quote, before work starts. Monthly fees begin when your website launches and are billed monthly in advance. There is no minimum term. We do not take payments through this website or charge a saved payment method without separate authorisation.
Each monthly plan includes hosting for the agreed website, routine technical upkeep, and registration or renewal of one agreed standard, non-premium domain while the plan is active. Premium or extra domains and paid third-party tools are additional only if approved in writing. Domain selection is subject to availability and any registry eligibility rules.
Routine edits mean small changes to existing text, images, links or contact details. Requests are scheduled within the included monthly time and the turnaround is agreed when the request is made. Unused editing time expires at the end of the billing month. New pages, redesigns, custom features and work beyond the allowance require a separate quote and approval before work starts.
We maintain the site and take reasonable steps to address issues, but cannot promise uninterrupted third-party hosting or domain services. We will discuss any proposed plan or price change before it takes effect. Updating this website does not itself change an existing agreed price.
If an invoice is overdue, we will contact you and provide a reasonable opportunity to resolve it before any service restriction, ordinarily at least 14 days after written notice. We will consider a genuine billing dispute before restricting service. Your legal rights remain unaffected.
4. Content and approvals
You are responsible for the accuracy of the business information you supply and for having permission to use supplied text, photographs, logos and other material. Please do not send passwords, payment-card details or unnecessary sensitive personal information through the quote form.
We will ask you to review the proposed site before launch. Timelines depend on the agreed scope and receiving content, access and feedback. We will discuss delays or changes with you.
5. Ownership and third-party services
You retain your rights in material you supply. On payment of the agreed initial build fee, you own the custom text, design and code we create specifically for your site, to the extent those rights can be transferred. Pre-existing tools, reusable components and third-party material retain their original ownership; you receive the permissions needed to use the agreed deliverable, subject to any disclosed licence terms.
Your domain is registered in your name or your business’s name, subject to registry requirements. You remain entitled to control or transfer it. On cancellation, we provide the available website files and reasonable assistance with transferring the domain. Basic file handover and domain-transfer assistance have no exit fee; migration work beyond that is quoted separately if requested. Third-party transfer fees or registry restrictions may apply and will be explained.
Outside providers control their own services. Search visibility, enquiries and sales depend on factors beyond a website, so no particular ranking or commercial result is promised.
6. Changes, cancellation and refunds
To change or cancel, email contact@sitesides.com. There is no minimum monthly commitment. Give notice before the next billing date to stop the next renewal. Cancellation takes effect at the end of the period already paid for, unless an earlier end date is agreed or required by law. We will confirm the dates in writing.
Your website remains hosted through the paid period. Arrange replacement hosting if you want it to stay online afterward. Domain registrations already paid for ordinarily continue until their registry expiry date, but Sitesides stops future renewals once the plan ends. We will provide available expiry and transfer information so you can take over management.
If you cancel the build before launch, we will account for the reasonable value of work already completed and approved, non-recoverable third-party costs, up to the agreed project price, and refund the unused balance. There is no separate penalty for cancelling. We will explain the calculation.
There is ordinarily no part-month refund when you choose to use the service until the end of the paid period. If we end service early, we refund any unused prepaid service fees unless a different remedy is required by law. We ordinarily give at least 30 days’ written notice if we choose to end an ongoing service for reasons other than a serious breach, urgent security issue or legal requirement.
These arrangements do not limit a right to a refund, cancellation or other remedy under the Australian Consumer Law or another applicable law.
7. Your rights and resolving concerns
Nothing in these terms excludes, restricts or modifies rights or remedies under the Australian Consumer Law or other laws where doing so would be unlawful. This includes applicable guarantees that services are supplied with due care and skill and are fit for a disclosed purpose.
If something is wrong, contact us with the details so we can investigate and discuss a reasonable solution. These terms do not require you to give up access to a regulator, tribunal or court. Western Australian and applicable Australian laws govern our services, without limiting any mandatory protections available to you.
8. Using this website
Please do not misuse the enquiry form, attempt unauthorised access or interfere with the website. Portfolio concepts are fictional examples, not representations of client work. Links to other websites are provided for convenience; their operators control their content and services.
We may update these website terms and show the date of the revision here. Updates do not retrospectively change an already accepted project agreement without agreement or a lawful basis.
